FMLA Legal Update

Court Ruling Clarifies Employers’ FMLA Obligations
Joe Bilby, Attorney | Stoll Keenon Ogden PLLC

Employers under the jurisdiction of the Family and Medical Leave Act (FMLA) should take note of a decision made earlier this year which requires employers to inform employees in writing about the method used to calculate leave time. In the case of Thom v. American Standard, Inc., 666 F.3d 968 (6th Cir. 2012), an employer that failed to specify how employees’ leave time would be calculated was held to have violated the FMLA.

FMLA-eligible employees are entitled to a total of 12 work weeks of job-protected, unpaid leave upon the birth of a child, the placement of a child in adoption or foster care, learning of a serious health condition, or other qualified medical and family events.

An employee is eligible to take up to 12 weeks of leave in each 12-month period. To calculate the 12-month period, employers can use one of four methods: the calendar year; the company’s fiscal year (or another fixed method); the backward-counting “rolling” method; or a method that begins the calculation from the first date when an employee takes leave.

The employer in this case failed to specify which of the four methods it used to determine the 12-month period until after it had terminated its employee for taking more leave days than permitted under the rolling method.

The consequences were severe: the employer had to provide back pay to the employee and pay attorney’s fees totaling more than $200,000, in addition to adjusting the employee’s termination date for pension and retiree health care purposes (or an annuity to cover the difference). The court also ordered the employer to pay additional liquidated damages of more than $100,000.

With this decision, the Sixth Circuit made clear that employers have an affirmative duty to inform employees about the method used to calculate FMLA leave time in advance of the employee’s leave. As a result of this case, FMLA-eligible employers should take the following three steps to ensure they are in compliance and reduce the risk of lawsuits:

1. Determine which of the four methods will be used for calculating the FMLA-mandated 12-month period.

2. Bring the selected calculation method and FMLA policy to the attention of current employees. The method should also be included in the employee handbook and stated in the documents provided to employees taking FMLA leave.

3. In the case of an employee who may have taken FMLA leave without receiving a clear statement about the company’s chosen method of calculation, work with the employee to resolve any differences. When in dispute or doubt, use the method which is most beneficial to the employee.

LSHRM Compassion in the Workplace Initiative Update

In January, LSHRM partnered with Metro Louisville to support its 10-year Compassionate City Campaign.  LSHRM’s role was to define compassion from a business perspective and to explore the role of compassion in the workplace.  In June, the LSHRM Compassion in the Workplace Project Team surveyed LSHRM members for feedback on organizational applications and examples of workplace compassion.  An overview of the survey results is available on the LSHRM website.

To learn  more about the survey and discuss the role of compassion within organizations, plan to attend the Project Team’s presentation at the KYSHRM State Conference, Wednesday, September 26, 2:30-4:00 p.m.  (The presentation has been preapproved for 1.5 HRCI Strategic Credit Hours).  Project Team presenters are LSHRM members:  Tiffany Cardwell, Rawleigh Richardson, Mary Rivard, Brad Shuck and Kelly Zeilman.

LSHRM Study Group

The LSHRM Study Group is back for Fall 2012! The Study Group meets on a weekly basis to review the SHRM Learning System as a means of studying for the PHR or SPHR certification exam.

If you are not familiar with these certifications, the PHR is a Professional in Human Resources and the SPHR is a Senior Professional in Human Resources. The material that is covered in these certification exams reviews knowledge in the six core areas of Human Resources:

  1. Business Management and Strategy
  2. Workforce Planning and Employment
  3. Human Resource Development
  4. Compensation and Benefits
  5. Employee and Labor Relations
  6. Risk Management

The Winter exam window runs from December 1st through January 31st. There are only two testing periods per year, so meeting application deadlines and reviewing the material is critical!

The LSHRM Study Group will meet at Webster University at 1031 Zorn Avenue, Suite 200. This is a FREE benefit for members of LSHRM. LSHRM is also able to offer the SHRM Learning System at a discounted rate for all Study Group participants.

WorldFest Update - Workforce Readiness

Here is an update on what our Workforce Readiness team is working on with the Mayor's Office. The last week of July, LSHRM was notified that someone from the Mayor's Globalization Office wanted to partner with LSHRM to add a Job Fair during WORLDFEST 2012. There was a brief meeting and Rawleigh Richardson, Director of Workforce Readiness, suggested that we form a team of various resources such as KentuckianaWorks, OET, Louisville Urban League, Carolyn H. Whitaker-Tandy with Congressman John Yarmuth's Office, and the Jewish Family Career Center to coordinate this event. This team has since met 2-3 times each week and has created the attached letter and application and booked the Galt House as a location next to the WORLDFEST event on August 31st, 2012 (Friday).

Rawleigh will need just a few volunteers for the table during the event. John Reliford, LSHRM's Chapter President for 2012 has said that he would be there representing our organization. We would like at least three additional volunteers. Two people would be at the tables assisting job seekers with a quick resume review. The other two would rotate at the table and help set-up during the event. The LSHRM table will have copies of the Workforce Readiness pamphlet and handouts on resumes, interviews, and job search website recommendations.

If you are interested in volunteering for this event, please contact Rawleigh Richardson at rrichardson@lshrm.org.
